Bagwell Insurance Claim Denied

Lawyers for Astros owner Drayton McLane and Connecticut General Life Insurance are bracing for litigation over Connecticut General's decision to deny the total disability claim the Astros filed to recoup $15.6 million of disabled first baseman Jeff Bagwell's salary this year.

Acknowledging that pain in his arthritic right shoulder had become too great, Bagwell went on the 15-day disabled list on Saturday. Twelve days earlier, Connecticut General had already denied the Astros' insurance claim.

"On March 13, 2006, Connecticut General Life Insurance Co. notified the Houston Astros that it had denied a total disability claim submitted by the Astros relating to Jeff Bagwell," said attorney Ty Buthod, a partner at the Houston law firm of Baker Botts, which is representing Connecticut General. "The company determined that there had been no adverse change in Mr. Bagwell's condition or ability to play baseball between the end of last season, when he was an active member of the roster, and Jan. 31, 2006, the date the policy expired.

"The company carefully reviewed the claim as submitted by the Astros and determined that the claim did not support a finding of total disability."

Bagwell Will Start Season On DL

Houston Astros first baseman Jeff Bagwell said Saturday he will start the season on the disabled list and isn't sure if he'll return this year.

The 37-year-old Bagwell, perhaps the most popular player in franchise history, spent the spring in a contentious battle with the team while he tried to prove he could still play despite a chronically injured right shoulder.

The Astros filed an insurance claim in January to recoup about $15.6 million of the $17 million Bagwell is guaranteed this season in the final year of his contract, arguing he is too hurt to play. He must stay on the injured list all season for the Astros to collect their money.

According to one prominent uniformed member of the Houston Astros, if Roger Clemens returns to the field this year, "I believe it'll be with us." The Astros are just as in the dark about Clemens' future as the Yankees are, but The Rocket's Houston-area ties and son Koby's presence in the Astros' minor league system pose significant factors.

Bagwell Still Hoping For Health

Jeff Bagwell hoped to have settled into first base by now. But 11 days before the National League champion Astros open the regular season at Minute Maid Park, the franchise's all-time leader in home runs and RBIs is still unsure if his injured right shoulder will let him play this year.

Bagwell is adamant that it's too early to say he won't play this season.

"I wouldn't give up on it quite yet," he said. "That could change.

"I played 15 years in the big leagues," Bagwell said. "That's 15 years longer than I ever thought I would have played. I've had a great career. I've had a lot of fun. I've met a lot of great people. If this is it, this is it. I'm OK with that. But as I've said all along, this was just an opportunity to see if I can do it again."

It Is A Goodbye For Clemens, Right Now

Roger Clemens, who seemingly enjoys constantly dancing around his retirement plans, released a statement following his start in Team USA's loss to Mexico last night that read, in part, "And for me, right now, it's goodbye."

Whether that means Clemens is actually quitting for good or it's more of a "see you in Houston in May" message remains to be seen. The one certainty is that Clemens still can pitch.
